What are the Duties of a Mediator?

A mediator seeks to resolve conflict by guiding the parties to a fair and equitable solution as determined by all participants. They do this by helping participants prioritize and focus of the issues most important to each side. They can clarify by pointing out the stronger and weaker points of each party’s case while offering solutions that neither side may have considered.

A mediator’s duties include:

1. A mediator will mediate in a fair manner without bias.
2. A mediator will recognize any conflict of interest and withdraw themselves if they are unable to remain impartial.
3. A mediator will keep all mediation details confidential.
4. A mediator will conduct meditations in a professional manner, treating all participants with respect by valuing their time and participation.
