If we can’t agree, how can mediation work?

Although many mediating parties are amicable and work well in mediation, there are also many parties who are very emotional about meeting face to face to discuss the issues of the dispute in front of the other party. Since Mediation is an informal process, the atmosphere in the Mediation session is that of conversation, not confrontation. If there is a party that becomes somewhat hostile during the Mediation, the Mediator always has the option to meet with each party individually to discuss the issues as opposed to having both parties in the same room face to face. This process seems to be very effective in working with the parties and assisting the parties to see the side of the other party and eventually come to an amicable settlement of the dispute.
